Welcome to TheHoneyCo ("TheHoneyCo", "we", "us", or "our"). These Terms & Conditions apply to your use of our website and to the purchase of products from TheHoneyCo within New Zealand. By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms & Conditions. Nothing here is intended to exclude, restrict, or modify any rights you may have under New Zealand law that cannot legally be excluded or restricted.

1. About TheHoneyCo

TheHoneyCo is a New Zealand business supplying packaged honey-based food products containing honey and selected botanical and nutritional ingredients. Our goal is to provide high-quality, properly labelled products while operating in accordance with applicable New Zealand food safety, consumer protection, advertising, importation, and labelling requirements. Our products are supplied as food products only where they meet the applicable legal classification and regulatory requirements.

2. Food product, not medical treatment

Unless expressly stated otherwise and legally permitted, TheHoneyCo products are sold as food products and are not medicines. Our products are not intended to diagnose, treat, cure, or prevent any disease, disorder, medical condition, or injury. Information provided on our website, packaging, advertising, social media, or other communications is provided for general product and consumer information only and is not intended to replace medical advice. If you have a medical condition, take medication, have allergies, are pregnant or breastfeeding, or have concerns about whether a product is appropriate for you, you should seek advice from an appropriately qualified healthcare professional before consuming it.

3. Health and product claims

TheHoneyCo aims to ensure that statements made about our products comply with applicable New Zealand laws and food standards. Any nutrition or health claim will only be made where we reasonably believe the claim is permitted, appropriately substantiated, and compliant with applicable regulatory requirements. Individual experiences may differ. Unless expressly stated and legally substantiated, we do not guarantee that consuming a TheHoneyCo product will produce any particular physical, physiological, sexual, hormonal, performance, or health outcome. Customer testimonials, reviews, social media content, or descriptions of individual experiences do not constitute a guarantee that another customer will experience the same result.

4. Ingredients and product information

Customers are responsible for reviewing the product label, ingredient list, allergen information, warnings, directions for use, storage instructions, and other information supplied with a product before consuming it. Product formulations may occasionally change. Where required by law, product packaging will identify applicable ingredients, allergens, advisory statements, nutrition information, net quantity, date marking, storage information, supplier information, lot or batch information, and other mandatory information. If there is an unintended discrepancy between the website and the product, customers should refer to the physical product label and contact us before consumption if clarification is required.

5. Allergies and sensitivities

Our products contain honey and may contain other botanical, plant-derived, nutritional, or food ingredients as stated on the product label. Customers must check the complete ingredient and allergen information before consumption. Do not consume a product if you know or suspect that you are allergic or sensitive to any of its ingredients. Where required under New Zealand food standards, allergen declarations, warning statements, and advisory statements will be provided on the product packaging. If you experience an unexpected or serious reaction after consuming a product, discontinue use and seek appropriate medical attention.

6. Directions for use

Products should only be consumed in accordance with the directions and information provided on their packaging. Do not intentionally consume a product in a manner inconsistent with applicable warnings or directions. Customers are responsible for using products appropriately and for considering their own circumstances, allergies, dietary requirements, medication use, and medical conditions before consumption.

7. Food safety and quality

TheHoneyCo takes food safety seriously. We aim to source, import, store, handle, distribute, and sell our products in accordance with applicable New Zealand food safety requirements. Products should not be consumed if the packaging or seal is materially damaged or compromised; the product appears contaminated or otherwise unsafe; the product is beyond an applicable use-by date; or a recall or food safety notice has instructed consumers not to consume the product. If you believe you have received a damaged, contaminated, incorrectly labelled, spoiled, or otherwise unsafe product, please do not consume it and contact TheHoneyCo promptly. Where appropriate, we may request photographs, batch or lot information, order details, and other information reasonably necessary to investigate a food safety or quality concern.

8. Storage

Customers must follow the storage instructions shown on the product packaging. TheHoneyCo is not responsible for deterioration or damage caused after delivery by improper storage, excessive heat, moisture, contamination, damage to packaging, or other handling inconsistent with the product's storage instructions, except where liability cannot legally be excluded.

9. Product recalls

If we become aware that a product may present a safety risk or does not meet applicable requirements, TheHoneyCo may take appropriate action including contacting affected customers, stopping sales, withdrawing stock, or initiating a product recall. Customers should follow any recall or safety instructions issued by TheHoneyCo or a relevant New Zealand regulatory authority. Where possible, customers should retain relevant packaging and batch or lot information until the product has been consumed.

10. Orders

By placing an order, you confirm that the information you provide is accurate; you are legally capable of entering into the transaction; you have reviewed the relevant product information; and you agree to these Terms & Conditions. Receipt of an order confirmation does not necessarily mean that an order has been finally accepted. We reserve the right to cancel or refuse an order where reasonably necessary, including because of stock errors, pricing errors, suspected fraud, regulatory requirements, product safety concerns, delivery restrictions, or circumstances outside our reasonable control. If we cancel an order after payment has been received and no product is supplied, we will refund the applicable amount.

11. Pricing and payment

All prices displayed on our website are in New Zealand dollars unless otherwise stated. GST will be included where required by New Zealand law. You agree to pay the price and any clearly disclosed delivery charges applicable to your order at the time of purchase. We may change prices at any time, but changes will not retrospectively alter the price of an order that has already been accepted.

12. Shipping and delivery

We will take reasonable steps to dispatch orders within the estimated timeframes displayed on our website. Delivery estimates are estimates rather than guarantees unless we expressly agree otherwise. We remain subject to our obligations under applicable New Zealand consumer law concerning delivery of goods. Customers are responsible for providing accurate delivery information. If an order is returned because incorrect or incomplete delivery information was supplied, additional reasonable delivery charges may apply before the order is resent.

13. Returns, refunds and consumer rights

Our products are consumable food products. For food safety and hygiene reasons, we generally cannot accept a return simply because a customer changes their mind after a product has been opened. However, nothing in this policy limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand law. If a product is faulty, unsafe, materially damaged, does not match its description, or otherwise fails to meet a guarantee required by New Zealand law, you may be entitled to an appropriate remedy, which may include replacement, refund, or another remedy. Please contact us as soon as reasonably possible if there is a problem with your order. We may request reasonable evidence such as photographs, order information, packaging, and batch details so that we can investigate.

14. Change-of-mind returns

Unless otherwise stated in a separate returns policy, TheHoneyCo is not required to provide a refund because you have changed your mind about a product. We may choose to offer a change-of-mind return at our discretion provided the product remains unopened, unused, sealed, and in a condition suitable for resale. This section does not affect any statutory rights available where a product is faulty or otherwise fails to comply with New Zealand consumer law.

15. Website and advertising information

We take reasonable care to ensure that information published by TheHoneyCo is accurate and not misleading. Product photographs may vary slightly from the product supplied because of packaging updates, manufacturing changes, screen displays, photography, or other reasonable variations. Nothing on our website or social media channels should be interpreted as medical advice. Where we provide information about ingredients, the information is intended to explain the product and its composition and does not automatically mean that every customer will experience a particular effect.

16. Reviews, testimonials and user content

Reviews and testimonials may reflect the personal experiences and opinions of individual customers. Individual results and experiences can vary. TheHoneyCo does not represent that an individual testimonial is a typical or guaranteed outcome. We reserve the right to moderate or remove unlawful, fraudulent, abusive, misleading, or inappropriate user-submitted content. We will not knowingly create or present fabricated customer reviews as genuine customer experiences.

17. Responsible use

TheHoneyCo products must be consumed responsibly and in accordance with the information supplied with them. You must not knowingly misuse our products or use them for an unlawful purpose. You must not represent, resell, relabel, modify, adulterate, or market TheHoneyCo products in a manner that creates misleading claims about the product or TheHoneyCo.

18. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by New Zealand law. To the maximum extent permitted by law, TheHoneyCo will not be responsible for indirect or consequential losses arising from misuse of a product, failure to follow product instructions, improper storage after delivery, unauthorised alteration of a product, or consumption despite a known allergy or contraindication. This section does not limit any rights or remedies available to consumers under the Consumer Guarantees Act 1993 or other rights that cannot lawfully be excluded.

19. Intellectual property

Unless otherwise stated, TheHoneyCo owns or is authorised to use the branding, logos, product photography, website content, graphics, designs, written material, and other intellectual property displayed through our business. You may not reproduce, distribute, modify, commercially exploit, or use our intellectual property without our prior written permission, except where permitted by law.

20. Privacy and third-party services

Personal information collected through our website or business will be handled in accordance with applicable New Zealand privacy law and our Privacy Policy, which should be read alongside these Terms. Our website may use third-party services such as payment processors, website hosting providers, analytics providers, and delivery companies. Use of those services may also be subject to the relevant provider's terms and privacy practices. We are not responsible for the independent operation of third-party websites or services, except to the extent responsibility cannot legally be excluded.

21. Compliance with New Zealand law

TheHoneyCo intends to operate in accordance with applicable New Zealand legislation and regulatory requirements, including where applicable the Food Act 2014; the Australia New Zealand Food Standards Code; applicable New Zealand supplemented food requirements; the Consumer Guarantees Act 1993; the Fair Trading Act 1986; the Privacy Act 2020; and other applicable regulations, standards, import requirements, food safety requirements, advertising requirements, and consumer protection laws. The applicable regulatory classification of a product will determine which specific requirements apply.

22. Changes to products or terms

We may update these Terms & Conditions when reasonably necessary, including to reflect changes to our products, website, business practices, or legal and regulatory requirements. The current version will be published on our website with the date of the latest update. Changes will not remove statutory rights that a customer already has in relation to an existing purchase.

23. Governing law

These Terms & Conditions are governed by the laws of New Zealand. Any dispute arising from these Terms or a purchase from TheHoneyCo will be dealt with under New Zealand law and through the appropriate New Zealand courts, tribunals, or dispute resolution processes.
